The Advantages of Chain of Custody Paternity Tests

The reliability and accuracy of a DNA paternity test depends primarily on two factors: (1) the level of confidence or certainty that the samples collected and submitted to the laboratory are those of the intended participants, and (2) the level of technical competence of the laboratory performing the DNA analysis. Of the different paternity testing options available to consumers, a chain-of-custody (COC) test performed by an AABB-accredited laboratory provides the highest level of trustworthiness.

A "chain-of-custody" (COC) paternity test, sometimes called a "legally-admissible" or "legally-defensible" paternity test, is one in which neutral third parties with no interest in the test outcome (1) obtain informed consent and positive identification-usually an instant photographs and/or government-issued photo IDs-for all tested parties, (2) collect, label, and package all samples in a tamper-evident manner, (3) receive and test the samples at the laboratory, and (4) document each stage of the testing process to ensure that a verifiable, traceable chain-of-custody is maintained. These procedures not only minimize misidentification and laboratory errors, but they also enable precise traceability of each step in the testing process, should an investigation be necessary.

Most labs performing COC paternity tests hold one or more accreditations or certifications that reflect their proficiency in various aspects of the testing process. In the United States, the most widely recognized accreditation program specific for paternity testing laboratories is that established and administered by AABB. Through regular inspections-or assessments-AABB ensures that the policies, processes, and procedures in place at its accredited labs adhere to AABB's published Standards for Relationship Testing Laboratories, which govern quality control and quality assurance in COC paternity testing. These Standards encompass the qualifications and training of staff, procedures for sample identification and chain-of-custody, technical proficiency in DNA sample analysis and data interpretation, validation of tests and instrumentation, and handling of incidents, errors, accidents, among other issues. AABB is approved by the U.S. Secretary of Health and Human Services as a body whose accreditation, in most states, qualifies a laboratory to perform chain-of-custody paternity testing for civil court cases (largely family law matters).

If test results may potentially be presented as evidence in civil matters to any government entity-including family courts, the IRS, U.S. Citizenship and Immigration Services (USCIS), Social Security Administration (SSA), and the U.S. military-or other official tribunal such as an Indian tribal council, then tested parties are advised to obtain a COC test and to ensure that the testing laboratory is AABB-accredited. In so doing, participants can be confident that their results are trustworthy, defensible in a court of law, and unlikely to face judicial challenge or rejection. Moreover, because sample identification and chain-of-custody is vigorously documented and maintained throughout the testing process, test participants may be protected and have legal recourse against the lab in the event of a lab error. While some paternity testing labs hold other accreditations that may provide additional assurance of reliability, AABB accreditation is considered the gold standard in the industry. In the State of New York, paternity tests must be ordered by a court or physician and performed only by laboratories certified by the New York State Department of Health. Most, if not all, of these laboratories are also AABB-accredited. As one might expect for paternity tests that must comply with strict regulatory requirements, COC tests performed by AABB-accredited labs are not only the most trustworthy, they are also the most expensive, typically ranging from $400 to $600.

Because the outcome of a DNA paternity test can completely change the course of a life-sometimes many lives-I believe that the highest priority of those seeking a paternity test should be obtaining a test that they can trust, even if that means spending up to $500 for a COC test as described above. If you decide that a non-COC test, such as a "home" paternity test, is the best choice for your personal situation, please take the time to consider the relevant concerns, limitations, and risks of your options, so that you can take proactive steps to minimize the concerns and maximize your confidence in the test results.

Best Outsourcing Model For Start-ups

What is the best outsourcing model for a start-up?

Every start-up needs to scale operations, especially development, at some point of time. However, they face many challenges such as

1. Availability of required skill set in the local geography to the build the right R&D.

2. High costs of hiring people with desired expertise. Additional costs in benefits administration and in general taking a longer term liability while the business has yet to prove itself.

3. Additional funds requirement to scale-up infrastructure to match with the team expansion.

4. Founder management getting swamped with operational issues due to increased team size while they need to focus more on technology, raising funds and new customer acquisition.

What are the options available to a start-up to get out of this tough spot and manage growth without having to invest significant $$s? Outsourcing to an offshore location is a viable option since there are geographies, like India/China, where talented manpower is available at a relatively lower cost.

Outsourcing sounds simple but may not be easy to execute. Standard outsourcing models present their own challenges to the start-up. Let's take a look at the options available:

1) Time and Material based contract: The offshore company provides you with a team for fixed duration and charges on a MM basis. While this model is good for established companies outsourcing peripheral developments, for a start-up the issues faced are:

a) Your intellectual property is being shared with engineers who will not stay with you over extended period. Once the T&M contract is done, there is no assurance that the same team will be available to you for extended work.

b) The offshore partner will possibly rotate engineers between various customers depending on their business needs. The engineers carry your residual IP with them when moving to next project, which could be with one of your competitors.

c) Offshore partners typically have high attrition rate. You can loose critical resources midway in the project.

d) As a start-up, your objective is to build a strong development team which stays with you for an extended period of time, continuously enhancing the IPR created. This objective is not met by T&M contracts

2) Fixed price contract: You define a statement of work (SoW) and the offshore partner executes the same with a lump sum price. Again the model works for established companies which can carve out a clear, unambiguous SoW and then invite bids from several partners. It fails for start-ups for the following reason:

a) Start-ups have to work in a reactive mode in early years. A critical requirement from that first customer must have higher priority than the long term roadmap. Hence, it is kind of impossible for you to carve out a SoW in concrete and use the same for awarding fixed price contract

b) Just like T&M projects above, you are taking a very high risk by exposing your intellectual property to employees of offshore partner. Remember that your IPR is possibly your only differentiation in the early years as start-up.

c) Creating a SoW is not a trivial job. Drafting one takes quite some time and it has to be fairly complete so that there are no gaping holes when deliverables arrive. A start-up management has to spend lot of effort in making SoW. This is really not-so-productive work for a founder of a start-up as it is neither leading to new customer acquisition nor raising of additional funds, the two most critical activities required to make a start-up sustain early years.

d) More often than desired, the deliverables from a fixed price contract do not match the expectation of the customers. There are always some gaps and mostly because of differences in understanding and even minor change in specifications. You as a start-up can not afford this to happen as for you time to market is most critical.

So what are your options? You do want to outsource but which is the best business model to adopt. Lately a new model has evolved the Build-Operate-Transfer (BOT) model. The BOT model is really cut out for start-ups more than established players. Here is how it works:

1) Offshore partner BUILDs a 100% dedicated team of qualified engineers as per the start-up requirement. Note that the team is not selected from an existing pool of resources but typically "hired fresh" for the start-up work. Every candidate is prescreened by start-up management. Team size is typically 4-8 people but could be more.

2) The offshore partner OPERATEs this team for a designated, pre-agreed upon period. Basically the offshore partner will provide complete infrastructure, admin, HR, payroll and other benefits to the team while they get working directions from the founders at the start-up end. So basically you get a 100% dedicated "virtual" team managed FOR you at an offshore location.

3) The offshore partner will TRANSFER the team to start-ups own offshore entity as and when latter secures funding to expand. The offshore partner actually facilitates setting up direct operation for its customer (govt. clearance etc.) and then moves the entire development team to this new outfit.

The BOT model clearly meets the "outsourcing pre-requisites" for a startup. Just to summarize:
- Your intellectual property stays with you all the time. It is shared only with employees who are on your payroll, indirectly first and directly at a later point of time.
- You have a fully functional offshore team but do not take any long term liability. You do not spend capex in building infrastructure etc.
- No need to spend precious time on creating SoW or detailed specs. Since the offshore team is functionally reporting to you, you can decide upon priorities as per your business needs.
- As a founder, you save precious time by not getting bogged down by admin, HR or payroll issues. Your offshore partner is taking care of all that. You just focus on proving your business model and being successful.

Can You Trademark Your Business Name?

A trademark is a distinctive image, word or other thing that associates with a product or service. So, can you trademark your business name?

Most people think trademarks are logo oriented. In some ways, this is true. The Nike Swoosh is clearly a logo trademark that stands out in peoples minds. When you see it, you immediately think of Nike and its products. While logos can clearly be trademarked, what about a business name? The answer is both yes and no.

A trademark is a consumer oriented thing. While it protects the intellectual property of businesses, it is a legal step designed to protect consumers. The basic idea is a trademark should point to a particular product or service and only be used by the company backing those items. This helps consumers in two ways. First, it represents an assurance of a particular type of quality associated with the products or services provided by the company. Second, it precludes other companies from causing consumer confusion by infringing on that mark.

When it comes to your business name, you can trademark it if certain requirements are met. I am going to avoid the legal mumbo jumbo that confuses people, and stick with a general rule of thumb. If you use your business name in advertising or on the product or service, you can trademark it. A classic example is "Google". Google is both a company name and used on the service itself. When you go to the home page of Google, you see "Google" prominently displayed. As a result, this business name can be trademarked.

If you do not use your business name in a direct communication to consumers, you cannot trademark it. Why? Well, there is nothing distinct about it that reminds consumers of the connect. TJMaxx is a well-known discount retail store. Most people have at least heard of the name. The company behind the name, however, is actually TJCos. Nobody has heard of "TJCos" and certainly do not associate it with a store. As a result, this business name would be difficult to trademark, if not impossible.

If your name is going to be a fundamental part of your marketing effort, you should consider trademarking it. If it is not, then your probably should save your money. Obviously, each situation is different, so make sure you speak with legal counsel in your area.

What Type of Assurance Do Reviewed Financial Statements Provide?

Often as a CPA I am asked to prepare financial statements for my clients. The basic purpose is to inform those that want to understand the finances of a business in a format that can be readily compared to other similar entities.

Reviewed financial statements provide a limited level of assurance that the statements meet the requirements of the US GAAP and are free of material misstatements or false or missing information. To perform the review, I will obtain a general understanding of: the organization's industry as well as information about their operations, products, and services, their accounting records, qualifications of their accounting personnel, the accounting basis on which the financial documents are presented, and the form and content of the financial statements. Then I review the information supplied by the client and make specific inquiries relating to accounting policies, record keeping and accounting practices, actions of the Board of Directors, and changes in business activities. The specific inquiries required to perform a review should address the following areas: related party transactions; accounting policies, problems, and areas of greater risk; uncertainties, contingent, current and long-term liabilities and assets; qualifications of accounting personnel and division of accounting duties; inventory; any departures from GAAP; revenues, expenses, accounts receivable, cash and equity accounts, and investments; and property, plant, and equipment assets and liabilities.

As a Certified Public Accountant I must obtain a reasonable basis for expressing limited assurance about the nature of the financial statements. This means I will apply various analytical procedures to identify unusual items or trends in the statements that may need explanation. If any material errors or misstatements are noted, then I will discuss these items with the organization's management for clarification or adjustments to the financial statements.

Upon completion of a review, I will issue a report that provides limited assurance that the reviewed statements are free of material misstatements or false/missing information and are found to be accurate, complete and fairly presented to meet the requirements of the US GAAP. Since the statements were reviewed and not audited, no opinion about their nature is expressed. The report also notes that the financial documents are a representation of management.

Birthday Party Games Treasure Hunt

The Birthday Treasure Hunt...

Make a Birthday (or any reason for a gift) into a fun time for all……

First the short, simple version:- Put a clue in a Birthday card that leads to another clue, then another clue, until eventually they find the gift..just like a real treasure hunt.

For many years I have not GIVEN Birthday or Christmas presents to my children, instead they receive their Celebration card and in the card is a simple clue written on a piece of paper. (Depending on the age and ability of the birthday child would depend on the clue they receive).

The general idea is to play treasure hunt on whatever scale you feel the recipient can manage...E.g. Young children from 4 to 10 would probably be restricted to the house and garden. Teenagers may like to travel to local malls or shops..for adults unless you have a rocket to play with ..the world is big enough!!

This Idea works like this.

Get a piece of paper and a marker pen and think of areas where you could put a clue that will direct them to another clue....e.g.. Clue--- “Where does Buzz light year go when the play room is tidy?” The answer is "the toy box" When they figure that out, tell them there is another clue in the toy box. They now go to the toy box and find a clue (may be fixed to Buzz Lightyear) it could say "where do you store your bike??" The answer could well be the shed or garage...so the child goes to the shed or where ever the bike is stored and there, fixed to the bike, is another clue.

The Treasure hunter will enjoy this much more than just getting the present given to them. Try it yourself( do a dummy run with your partner and see what fun it is).I suggest making the treasure hunter work a bit, so why not put the first clue down stairs and the second one up stairs and then the third one in the garage..think of two places a long way from each other then watch and enjoy as your treasure hunter runs around the place looking for the next clue!

After four of 5 clues (or more if you like, sometimes a clue could send them to the fridge for an Ice cream..then they find a clue fixed to the ice cream!). They eventually find the present that you may have hidden in a draw or under the settee.
Some clues can be tricky so you may have to give hints or tips. This could take the form of the game “charades” where you can give a clue, but you can’t speak, you only give signs.

Writing the clue is especially suited to personal family jokes or Information i.e. Clue:- “This is where the item that Granny broke last Christmas used to be”....may be she broke the vase on the fireplace, so they go to the fireplace where the vase used to be and find a clue there. (for an adult version, I guess you could hide the clues about your person! I shall say no more on that!!)

There are many variations on this simple Idea, for example... for teenagers this can be made into your major party game. Your clues could suggest they go to a few local shops or places of interest. The way that works is to select the places you think would be good to visit (may be you know the shopkeeper or assistant there) and deposit a clue in a brightly coloured envelope with the shopkeeper or assistant at each place. When preparing for the treasure hunt, just go to the selected place and explain you have a treasure hunt for a party game and would they mind if the their establishment was a place for a clue to be kept? (I find giving the assistant a few bucks as a tip is a good way to get it two work smoothly).
If the assistant agrees check they know what your treasure hunter looks like and give them a password that the treasure hunter must say before they receive the clue envelope. Tell them an approximate time (and day) that your treasure hunter should arrive. When the treasure hunter arrives they ask for the password (which was on the previous clue), if it is correct handover the clue. Once, in a candy shop, I pre paid for six packets of candy, this way, when my lad and his mates came in, they got a packet of candy as well as the clue...

As for the clues themselves write them in big letters on a sheet of A4 or A5 as you may have quite a few people in the treasure hunt party all wanting to read the same clue. The bigger and brighter the envelope you put the clue in , the better! (I tend to keep all the envelopes the same size and colour, this helps with continuity and is an assurance they are getting the correct envelope). You can make the treasure hunters work out the location of the next clue with a word game. An anogram of GOD has the clue under their food bowl…

You can really put some work in and bury a clue in a box or a bag, may be in the garden or even a public place like a beach or under some stones in a park. The places to hide the clues are endless..as the envelope has no value as such they should not be stolen if you hide them well.

How do they get around?/ they could all be on their bikes or you can say you will be the driver..that way you can enjoy the fun, they get to be the back seat driver and keep you can an eye on them all.

Installing the Corner Bead

After you have hung the walls and ceilings you will need to install the corner bead. Make sure you put the sheetrock inside all the windows and the outlets are all cut out. Rasping the edges and corners off all the hung sheetrock will make installing easier.

Corner Bead

There are two types that come in various lengths:

1 - Bull Nose
2 - Standard Square

There are two types of material for the two types:

1 - plastic
2 - metal

There is no difference in how to install the plastic or metal.

Measure the corners and cut the piece to fit, using Tin Snips. If you have a corner that is longer than the piece you have and need to use more than one piece per corner, do not overlap them, "butt it up". Put them as close together as possible and follow the instructions below.

Bull Nose: There are two ways to install this type.

1 - gluing: these are spray adhesives. The best one recommended is Corner Bead Spray Adhesive. Use according to manufacturer Instructions. Spray the adhesive on the entire inside of your cut piece. Put it on the corner and apply pressure in the middle, working upward with one hand and downward with the other. Making sure there are no bumps or bubbles on the edges. Allowing to dry over night gives that added assurance that when you are mudding you know your not going to get it under the sides and won't have a fix-it project to do later because it lifted.

2 - nailing: the best to use is regular sheetrock nails at an inch and 1/8 to inch and 1/4 . Put your cut piece on the corner and put one nail in the center of the corner bead on each side. Working upward first then downward put a nail in at about 2 inches apart. Make sure the edges do not lift. If its does, put a nail in where it is lifted. You can start mudding immediately afterward.

Standard Square: There are three ways to install this type.

1 - gluing: same as above

2 - nailing: same as above

3 - crimping: Please note: you cannot crimp the plastic. Put your cut piece on the corner and put the crimper in the center first. Apply pressure to the crimper and hit it with the rubber mallet. This style pinches the corner bead to the corner by pinching both sides simultaneously. Work upward first then downward. Once it's all crimped, check for any lifting. If there is lifting crimp down the part(s) that are lifted. You can start mudding immediately afterward.

Life Insurance 101

All types of Life Insurance fall into one of the four groups explained below, which type you use depends on the type of risk you wish to protect and the funds you have available.

Term Assurance

Cash lump sum paid out in the event of death

Straight term assurance is still a very cost-effective way of providing financial protection for the family or business. A lump sum is normally provided when a claim is made which is paid into the estate of the policyholder.

In order to avoid complications with delays in probate or inheritance tax, an appropriate trust can be used so that any payment is made direct to the beneficiaries.

It is also possible to have the cover indexed according to inflation, so that the level of cover remains the same in real terms. Since there is no element of saving, the plans do not acquire a surrender value. If you wish to include this option, you could opt for convertible term assurance.

Family Income Benefit

A regular income paid following death during the term of the plan

This type of plan provides for a regular income to be paid out in the event of the death of the life assured during the term of the policy. With each month that passes, the liability which the insurance companies is taking on decreases by a set amount. This enables the costs to be kept down to a minimum and is often the least expensive plan available.

The benefits can be written in trust to avoid legal delays and any possible
liability to inheritance tax.

Mortgage Protection.

This type of plan is also a term policy which covers the declining balance of a repayment mortgage. This enables the cost to be kept to a minimum but make sure that the interest rate figure is high enough for any possible increases in the mortgage rate.

Whole of Life Cover

Provides cover for the rest of your life

The main disadvantage of term cover is that at the end of the term, cover ceases and any new policy has to be underwritten according to the age and health of the policyholder at that time. When a whole of life policy is taken out, the policyholder has guaranteed insurability for the rest of their lives, regardless of any change in their health.

This means that initial premiums are likely to be higher than term assurance cover, but the plan has far more flexibility. It therefore depends on your personal circumstances as to which plan is likely to best suit your requirements.

Critical Illness Cover

In recent years, the need for protection for those who actually survive serious illness or accident has become more apparent. It has been described as 'life cover for the living'.

Most plans cover the common conditions such as heart attack, stroke and most forms of cancer, but there is variation on more rare conditions. In addition to specific illnesses, it is quite common to have permanent disability cover. If you become permanently disabled and unable to return to work, the plan pays out. There is however, a wide variation in the definition of 'return to work. Some plans would only cover you if you were totally unable to work. Others have an own occupation? clause so that if you were unable to return to your normal occupation, a claim could be made. This is an extremely important fact to bear in mind when selecting your insurer.
